Marketplace Declaration & Intermediary Status Disclosure

This Marketplace Declaration constitutes a legally binding disclosure issued in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and Rule 4 of the Consumer Protection (E-Commerce) Rules, 2020 under the Consumer Protection Act, 2019.

Faceons Internet Private Limited ("Company", "Jollyfer", "We", "Us") operates the online platform Jollyfer.com (including associated mobile applications) strictly as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. Our platform serves purely as a technological framework for enabling independent Third-Party Service Providers ("Service Partners") to list, display, offer, and sell their independent lifestyle, beauty, wellness, and personal care services to end consumers ("Customers").

Jollyfer.com is an electronic marketplace aggregator. The contract for the sale and rendering of any service listed on the platform is strictly a bilateral contract entered into directly between the Service Partner and the Customer. Jollyfer is not a party to such transactions, nor does it assume any contractual obligations arising from agreements made between Users and Service Partners.

To the maximum extent permitted under applicable law, Jollyfer, its directors, officers, employees, affiliates, agents, and representatives expressly disclaim any liability for any direct, indirect, incidental, consequential, special, or punitive damages resulting from services booked through the platform.

Cap on Financial Liability: Without prejudice to the absolute disclaimers above, should Jollyfer be found liable by a court of competent jurisdiction notwithstanding these terms, the maximum cumulative liability of Jollyfer for any claim arising out of or related to platform usage shall be strictly capped at the total facilitation commission actually retained by Jollyfer for the specific transaction giving rise to the claim, or ₹1,000 (Rupees One Thousand Only), whichever is lower.

All Service Partners accessing or offering services on Jollyfer.com explicitly warrant full compliance with Indian statutory requirements and undertake the following mandatory obligations:

In accordance with the Information Technology (Intermediary Guidelines) Rules, 2021, Jollyfer conducts reasonable due diligence during onboarding. However, onboarding checks do not constitute an endorsement, guarantee, or warranty of partner quality or identity truthfulness.

Payment collection services are rendered through RBI-authorized payment gateways and aggregators. Jollyfer acts as an intermediary collection agent solely for processing transaction settlements.

Jollyfer processes personal data as a Data Fiduciary in strict compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and Section 43A of the Information Technology Act, 2000.

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines) Rules, 2021 and Rule 4(4) of the Consumer Protection (E-Commerce) Rules, 2020, Jollyfer has appointed a dedicated statutory Grievance Officer.

Governing Law & Arbitration: This Declaration shall be governed by the laws of the Republic of India. Any dispute, legal action, or proceeding arising out of or relating to platform usage shall be referred to sole arbitration under the Arbitration and Conciliation Act, 1996 in Bhubaneswar, Odisha. Subject to arbitration, the courts at Bhubaneswar, Odisha shall hold exclusive territorial jurisdiction.

Jollyfer facilitates institutional alliances for B2B engagement. Commercial partners acknowledge that Jollyfer acts solely as a technological booking facilitator.

Jollyfer reserves the absolute right to amend, modify, or revise this Marketplace Declaration at any time to align with legislative updates, judicial precedents, or operational changes. Continued platform usage following publication of revised terms constitutes binding acceptance.

If any clause of this Declaration is held invalid or unenforceable by a court of law, such clause shall be severed, and the remaining provisions shall continue in full legal force and effect.

All trademarks, logos, brand names, software code, UI designs, and proprietary databases on Jollyfer.com are the exclusive intellectual property of Faceons Internet Private Limited. Unlawful scraping, reverse engineering, or unauthorized commercial reproduction is strictly prohibited and subject to civil and criminal prosecution under the Indian Copyright Act, 1957 and Trademarks Act, 1999.
